Any advice? (Final check and W2 issues)

I left my work in November of last year because I had moved. All seemed good, right? Well, around January, I called to make sure they had my new address, so they could send my W2s and my final check.
They claimed they no longer had my W2 from 2009-2010.. which I find suspicious, since they are legally required to keep records of those for, I think, three to five years. They claimed that they don't keep them past the tax season they're for...
So, whatever, I only worked like two months that year anyway.
So, I eventually get my W2 from last year, so no problem, right? Until the roommate in the apartment moves away, and we clean up what's left, and my W2 is gone.
No problem, no problem. I call my employer up, because I still hadn't gotten my check, and request the replacement W2 and find out about the check.
They claim they mailed the check and it had been cashed. I told them that I hadn't gotten it, so it wasn't me.
So, they threaten to take off fees for cancelling that check, fees for printing a new one, fees for mailing, etc.
So I think, whatever. I explain that I need my replacement W2, and they start going on about how busy they are and how they "don't know when they can get it to me". What-evs, I'll wait. This is all in February.
March flies through, I'm calling every couple weeks to check up. I request they mail this check registered mail, and they -agree- to do so, at my expense. I'm like, sure. You're already taking money out for this other ridiculous trash anyway.
April comes, and around April 1st, I realize it probably won't be there by the time taxes come around, so I file for an extension. Lucky choice, that was. It never came.
Now here I am, mid-MAY, after calling every other week to check, and I finally got off the phone with the owner of the place I worked.
He claims to have mailed my check and W2, again.
I haven't seen hide nor hair of it.
I ask if he mailed it Registered mail, like I'd requested....

No. No, he hadn't. Because it was "too expensive" and he "wasn't going to pay it."

I'm not even sure he sent anything in the first place now. >:/
What do I do from here? I just tried calling the Department of Labor, but they're not answering.

<a href="http://www.irs.gov/pub/irs-pdf/f4852.pdf">Here's a link to a form called the 4852</a> (it's a .pdf) and is supposed to work as a replacement W2. If you receive your replacement W2 afterwards and the amounts differ a lot from what you entered, you can send an amendment form.<br /> <br /> Your employer cannot withhold your last check, nor can they lie about the status of it. If the check has been cashed, they can't put a stop payment on it - they can only then investigate fraud. The fact that they told you this smells of rotting carp.
